These Terms & Conditions apply to the use of the Webtech Software Solution website at webtechsoftware.co.in and to general enquiries concerning our digital services.
A website page cannot describe every commercial or technical term of every project. For that reason, the scope, price, delivery schedule, payment milestones, revisions, support obligations and any special conditions for a particular engagement should be confirmed in the relevant quotation, proposal, statement of work, invoice, email, message or other written communication accepted by the client.
Where a project-specific written term conflicts with these general website terms, the project-specific term will normally govern that project to the extent of the conflict.
Website use
The information published on this website is provided to describe Webtech Software Solution, our services and ways to contact us. You may use the website for lawful business and informational purposes.
You must not knowingly attempt to gain unauthorised access to the website, server, forms, accounts or restricted systems; introduce malicious code; interfere with normal website operation; misuse enquiry forms; impersonate another person or organisation; or use website content in a way that infringes applicable rights or laws.
We may update, correct, reorganise or remove website content when reasonably necessary. Temporary interruptions may also occur because of maintenance, hosting, security, connectivity or third-party service issues.
Services and project scope
Webtech Software Solution provides digital services that may include website design and development, custom software, mobile applications, ecommerce solutions, design-related work, digital marketing and related technical services.
The exact deliverables for a project are limited to the work described in the applicable accepted quotation, proposal, scope document or written project communication. Features, pages, integrations, platforms or services not included in that agreed scope should not be treated as automatically included.
Estimated schedules depend on the agreed scope, technical complexity, client response times, availability of required content or access, third-party dependencies and timely approvals.
Quotations, proposals and project acceptance
A quotation or proposal may describe the proposed scope, estimated charges, payment milestones, delivery assumptions and other commercial conditions. Unless the document states otherwise, a quotation should not be treated as an indefinite commitment to availability, price or delivery dates.
A project may be treated as accepted when the client confirms approval in writing, pays an agreed advance or milestone amount, or otherwise authorises work to begin under the stated commercial terms.
If requirements materially change after acceptance, Webtech Software Solution may provide a revised estimate, timeline or additional charge before performing the additional work.
Payments, invoices and project progress
Project fees, applicable taxes, advance payments, milestone payments and due dates should be specified in the relevant quotation, proposal, invoice or other written commercial communication.
Work may be scheduled or continued according to agreed payment milestones. If a payment, required approval, content item, credential or other client dependency is delayed, the associated delivery schedule may also need to be adjusted.
Any refund, cancellation adjustment or credit, where applicable, will depend on the project-specific written terms, the work already performed, third-party costs already incurred and the circumstances of the relevant engagement.
Client responsibilities
Clients are responsible for providing accurate requirements and the information reasonably required to complete the agreed work. This may include text, images, branding materials, product information, business details, technical access, hosting access, domain access, API credentials and timely feedback.
The client is responsible for ensuring that materials supplied to Webtech Software Solution can lawfully be used for the project and do not knowingly infringe another party's copyright, trademark, privacy, contractual or other rights.
Clients should review important names, prices, contact details, legal notices, product information and other business-critical content before final publication or launch.
Revisions, additional work and change requests
Revision rounds and the type of revisions included in a project depend on the agreed project scope. A revision normally means a reasonable adjustment to work already included in the scope rather than a new feature, new concept, new platform or substantial redesign.
Requests that materially expand or alter the accepted scope may be treated as additional work and may require a separate estimate, additional payment and revised delivery timeline.
Third-party platforms, software and services
Some projects rely on products or services operated by third parties, including domain registrars, hosting providers, cloud services, payment gateways, SMS or email providers, social platforms, analytics services, advertising platforms, app stores, APIs, plugins, libraries and external software.
Those third-party services may have their own terms, pricing, subscription requirements, approval processes, usage limits, security controls and service availability. Webtech Software Solution does not control changes made independently by those providers.
Unless expressly included in the project quotation, third-party licences, subscriptions, advertising spend, domain charges, hosting fees, app-store fees, gateway charges and similar external costs are separate from our professional service charges.
Domains, hosting, accounts and credentials
Where domain registration, hosting or another external account is purchased or managed for a client, the relevant third-party provider's terms continue to apply. Renewal dates and recurring charges should be monitored carefully because expiry can affect website, email, application or service availability.
Clients should maintain secure control of their account credentials and recovery information. Passwords, API secrets and administrative access should only be shared through appropriate channels and should be changed when reasonably necessary for security.
Intellectual property and project materials
Ownership and licence rights for final project deliverables are subject to the terms agreed for the relevant project and to full payment of any amounts required under those terms.
Third-party software, open-source components, stock assets, fonts, plugins, libraries, frameworks, APIs and similar materials remain subject to their respective licences and are not transferred beyond the rights those licences permit.
Pre-existing tools, reusable development methods, generic code, frameworks, utilities, workflows, templates and know-how that were not created exclusively for a specific client may remain reusable unless a written project agreement expressly states otherwise.
Portfolio and project references
We may wish to refer to completed work as part of our professional portfolio or service presentation. Confidential projects, restricted materials or work subject to a non-disclosure obligation should not be publicly presented contrary to the applicable agreement.
If a project has specific confidentiality or portfolio restrictions, those restrictions should be communicated and agreed in writing.
Support, maintenance and post-launch work
Unless ongoing support or maintenance is expressly included in the accepted project scope, post-launch updates, content changes, feature development, server work, compatibility adjustments and third-party troubleshooting may be treated as separate services.
Where a support period is included, its duration, coverage and exclusions should follow the relevant quotation, proposal or written project terms.
Search, advertising and digital marketing results
Search engines, advertising networks, social platforms and other digital channels use systems and policies that can change without our control. Rankings, traffic, leads, sales, advertisement approvals, account status and campaign performance can therefore vary.
Unless a specific measurable commitment is expressly agreed in writing, no particular search-engine position, revenue amount, lead volume, advertising result or other business outcome should be considered guaranteed.
Availability and limitations
We aim to provide professional services and reasonable technical care, but digital products can depend on browsers, devices, operating systems, internet connectivity, hosting infrastructure and external services that are outside our direct control.
To the extent permitted by applicable law, Webtech Software Solution should not be responsible for losses caused solely by unauthorised client-side changes, third-party outages, third-party policy changes, expired external services, compromised credentials outside our control, malware introduced through external systems or other events that could not reasonably be controlled by us.
Nothing in these Terms & Conditions is intended to exclude or limit any responsibility that cannot lawfully be excluded or limited.
Suspension of work or services
Work may be paused where reasonably necessary because of overdue payments, missing client dependencies, security concerns, unlawful instructions, material scope disputes or circumstances that prevent safe or practical continuation of the project.
Where possible, the relevant issue should be communicated so that the parties can determine the next practical step.
Cancellation or termination
A client may request cancellation of a project by written communication. The financial and delivery consequences of cancellation will depend on the agreed project terms, completed work, committed resources and any non-refundable third-party costs already incurred.
Webtech Software Solution may also discontinue an engagement where continuing the work would be unlawful, unsafe, technically impractical, materially outside the agreed scope or subject to unresolved payment or cooperation issues.
Changes to these Terms & Conditions
We may update these general website Terms & Conditions when our website, services, technology, business practices or applicable requirements change.
The current version will be published on this page and the “Last updated” date will be revised when appropriate. Terms already agreed for a specific project remain subject to the written terms applicable to that engagement.
